Legal Issues


A database is being formed that should have all of us helping.  The database is for Right of Way Violations and an effort to get the laws changed here.  This effort is strictly no profit.   They are not asking for money or donations.  They want to get the laws changed to protect bikers from having to live with the knowledge that the person that hit them got off with a $100 fine or ????
 
All they need is information from individuals, up to 10 years back, that have been in an accident where a Right of Way Violation has occurred.  They do not need strictly information on bikers and bike accidents, although this is where we are at.  Bicycle accidents, pedestrian accidents can be included.  This way they can not call us a special interest group that are strictly for bikers or motorcyclists.
 
We are collecting information from anyone, anywhere.  In state or Out of State.
 
Please pass this email and link to as many people as possible.  The more data they can collect, the more help we will receive, the more serious we will be taken when we present it to a legislator to change this travesty.

The Issue:  Inattentive, distracted, careless or reckless vehicle operators violate the right-of-way of vulnerable roadway users such as motorcyclists, bicyclists, and pedestrians. The more common Right-of-Way violations are those that occur at intersections, stop or yield signs, and vehicles turning left (in front of you). These operators are responsible for many near-miss and actual collisions that injure, maim, and kill thousands of people on the roads; a nationwide problem, and Colorado is no exception. Far too often in cases of right-of-way violations, the penalty issued to the at-fault party where a vulnerable road user is involved is the same as “dinging” a car; an infraction or minor offense with a small fine, that may also include a plea bargain to a lesser violation. The victims and their families are rightfully outraged and bitter. In 2003, eleven state legislatures had Right-of-Way bills considered with a number of them being signed into law. Each bill sought penalty enhancements to complement existing law, increasing accountability.

 The Current Goal and Project:  The time has come for us in Colorado to make a difference; we understand that the problem exists. The initial and necessary first component must be to document, catalogue, and archive individual case histories into a database. This will be the very foundation that establishes a compelling need for improvement and change. The PEPCO Data Alliance has been created to assimilate and gather this information. It is imperative that individuals, families, and their friends who have been directly affected and/or are interested in a just and proper cause supplement the effort by providing their documentation to help the Project along. 

You Can Help:  We are asking for information through roughly the last ten years – 1990’s to the present – and anticipate a years’ time of data collection. You who ride motorcycles, bicycles, or walk or otherwise use the road in a capacity different from the mass of vehicles are welcome to contribute. 1) Penalty enhancements

2) Further public awareness by use of available highway federal funding

    (Safety & educational - Section 402)

3) Consistency and fairness of law enforcement, prosecution, and the courts

4) Offenders education courses

 The Strategy:  The Project will continue to be refined and tuned to accommodate the mission as we move ahead.

 Who We Are:  We’re a few individuals intent on making a difference for the future; we’ve had the injury experience ourselves, have lost friends and had others injured, experienced the realm of emotions, and experienced the shortcomings and disappointments of the “legal system”.
